Terms & Conditions of Sale
These Terms govern your purchase of any product from nortiasundials.com. Please read them carefully — by placing an order you confirm that you have read, understood, and agree to them.
If you are a consumer resident in the European Economic Area (EEA) or the United Kingdom, you have additional statutory rights that these Terms do not override. Nothing in these Terms is intended to limit those rights.
1. Who you are buying from
The seller is:
BWE Ltd. (trading as Nortia Sundials and Atelier Nortia) A limited liability company registered in the Republic of Bulgaria Reg. No. 204048699 · VAT BG204048699 Registered office: Varna, Bulgaria Email: orders@nortiasundials.com
References to "we," "us," and "our" in these Terms mean BWE Ltd. "You" means the customer.
2. The products

3. Placing an order
You configure your dial in the calculator (latitude, longitude, wall orientation, diameter, optional features), then select the variant you want and proceed to checkout. Checkout is handled by Stripe Payments Europe Limited. You pay by debit or credit card, or by another method Stripe offers at checkout in your region.
A binding contract between you and us is formed when we send you the order confirmation email, not when you click Pay. We reserve the right to refuse or cancel an order before that point in the rare cases where:
- The product is unavailable (a 3D printer is broken, materials are out of stock);
- We discover a manifest pricing error on the Shop page;
- We reasonably suspect the order is fraudulent or made in bad faith;
- We cannot deliver to your country (sanctioned jurisdictions, etc.).
If we cancel before forming the contract, we'll let you know and refund any payment in full.
4. Prices, currency, and VAT
- All prices are shown in euro (EUR) on the Shop page.
- For buyers in the European Union, prices are VAT-inclusive. We are VAT-registered in Bulgaria (BG204048699) and account for VAT under the EU One-Stop-Shop (OSS) scheme at the rate applicable in your country of residence.
- For buyers outside the EU (United States, Canada, United Kingdom after Brexit, Rest of World), the same prices apply and no Bulgarian VAT is charged. Your country may apply import VAT, duties, or sales tax on receipt of the parcel — see §8 (Customs).
- Shipping is added at checkout for physical orders and depends on the destination zone.
- A VAT invoice can be issued on request. Email orders@nortiasundials.com with your order number and the billing name and address you'd like on the invoice. We provide invoices manually for the moment; we may switch to automatic issuance via Stripe in future.
5. Payment
Payment is by card via Stripe. You authorise us to charge the price (including shipping where applicable) at the moment of checkout. We do not store your card details — they are handled directly by Stripe under PCI-DSS rules.
If the payment fails, the order is not placed.
6. Delivery — digital products
Digital products (PDF Kit, SVG file, the digital portion of any Bundle) are delivered immediately on successful payment:
- A download link appears on the order success page after Stripe returns you to our site.
- The same link is sent to your email address.
- The link remains valid for 30 days from purchase. After that, write to us and we will re-send it.
7. Delivery — physical products
The Alignment Jig (and the jig portion of any Bundle) is 3D-printed to order to your dial specification. Production typically takes 3–5 business days; we then dispatch via standard tracked parcel within 5–7 business days of the order date. Delivery times after dispatch depend on your zone — see our Shipping Policy.
Risk in the goods passes to you on delivery. Title passes to you on full payment (which has already happened by the time we ship).
8. Customs, duties, and import taxes (orders outside the EU)
For deliveries outside the European Union, any customs duties, import VAT, sales tax, brokerage fees, or other charges imposed by your country are payable by you to the carrier or the customs authority on delivery. We have no control over and cannot estimate these charges. We declare the parcel honestly with the order value and a contents description; we cannot under-declare to reduce charges.
9. Your right of withdrawal (consumers in the EEA / UK)
Under EU Directive 2011/83/EU (and equivalent UK law) you normally have 14 days from delivery (for goods) or from purchase (for digital content) to withdraw from an online consumer contract without giving reasons.
This right is subject to exceptions that apply to two of our products:
9.1 Digital content — Article 16(m) exemption
Digital products (PDF Kit, SVG file, and the digital portion of any Bundle) are delivered immediately on purchase. Under Article 16(m) of the Directive, the right of withdrawal does not apply to digital content delivered with the consumer's express consent and acknowledgement that they thereby lose the right.
At checkout, we ask you to tick a box confirming:
"I expressly consent to immediate delivery of the digital files and I acknowledge that, by doing so, I will lose my right of withdrawal once the download has started."
If you tick this box and the download starts, the right of withdrawal does not apply to the digital portion of the order. If you do not tick the box, we cannot deliver the digital files immediately, but you keep your 14-day right of withdrawal.
If you bought a digital product and have not yet downloaded any of the files, you can still withdraw within 14 days by emailing us — we'll cancel and refund in full.
9.2 Custom-made goods — Article 16(c) exemption
The Alignment Jig is 3D-printed individually to your dial's dimensions. Under Article 16(c) of the Directive, goods "made to the consumer's specifications or clearly personalised" are exempt from the right of withdrawal. We explain this clearly on the Shop page and at checkout. By ordering the Jig, you accept that the 14-day right of withdrawal does not apply to it.
If you change your mind before production starts, we will still cancel and refund as a goodwill gesture — see the Refunds Policy.
9.3 No exemption for other situations
The above exemptions apply only to change-of-mind withdrawal under the Directive. They do not affect your rights if the product is defective, damaged, wrong, or non-conforming — see §11 below and the Refunds Policy.
10. Damaged, wrong, or undelivered orders
If your jig arrives damaged or is the wrong item, contact us within 7 days of delivery with photographs and your order number. We will refund or reprint and re-ship at our cost, and you do not need to return the damaged or wrong item. See the Refunds Policy for the procedure.
If your parcel hasn't arrived in a reasonable time after dispatch, see our Shipping Policy.
11. Two-year consumer guarantee
If you are a consumer in the EEA, EU Directive 2019/771 gives you a 2-year guarantee on physical goods from delivery. Within those two years, if the jig develops a fault traceable to manufacture or materials (rather than wear, accident, or misuse), you are entitled to a free repair, replacement, price reduction, or termination of the contract under the conditions set by that Directive (transposed into Bulgarian law as Закон за предоставяне на цифрово съдържание и цифрови услуги и за продажба на стоки).
For digital content, EU Directive 2019/770 provides analogous protection: if the PDF or SVG file does not conform to its description, you can ask us to bring it into conformity, or to refund the purchase.
These statutory rights are in addition to the remedies in §10 and the Refunds Policy.
12. Licence to use the digital files
When you buy a PDF Kit, a PDF Kit + SVG, or a Bundle containing those files, we grant you a non-exclusive, non-transferable licence to:
- Print, reproduce, and use the files once to construct a single sundial for yourself or for someone you know;
- Print the kit at the size we calculated for your dial; you may not redistribute the file or resell the kit;
- Use the SVG file with a vinyl cutter, plotter, laser cutter, or similar tool you own or have lawful access to, for the same single dial.
You may not:
- Redistribute, share, resell, or sub-license the files or any derivative;
- Use the files to produce dials for commercial sale;
- Remove our authorship or copyright markings from the files.
Each PDF Kit is computed for a specific dial configuration; the geometry is unique to that order. We watermark the PDF discreetly with your order reference so that any leaked copy can be traced back to its purchase.
If you want to use the files commercially — for example, to make and sell sundials based on our calculations — please write to us first. We are open to commercial licences but they need to be agreed separately.
13. Warranties and limitations
The free PDF drawings, the calculator, and any informational content on the site are provided as is, for informational and educational purposes. While we take care that the geometry is correct, we make no warranty that any specific dial built from them will achieve any particular accuracy in practice — accuracy depends on installation, the surface, the buyer's measurements of latitude and wall orientation, and other factors outside our control.
For paid products, the warranties in §11 apply as required by EU law and these Terms do not exclude any liability we cannot exclude under mandatory consumer law.
To the maximum extent permitted by law, our liability for any claim arising from or relating to your use of the site or your purchase is limited to the amount you paid us for the order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, savings, or opportunities.
Nothing in this section limits liability that cannot be limited by law — for example, liability for death or personal injury caused by negligence, for fraud, for breach of mandatory consumer rights, or for gross negligence.
14. Cancellation by us after the contract is formed
We may cancel an order after the contract is formed only:
- For damaged or non-conforming production we cannot remedy;
- Where we cannot legally deliver to your jurisdiction;
- For chargebacks, fraud, or other order disputes.
In any such case we will refund any payment in full.
15. Communications
We will communicate with you by email at the address you give us at checkout. Please keep that address valid and check it for our messages. If you reply, please include your order number.
16. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control: postal disruption, customs delays, supplier failure, fires, floods, pandemics, war, sanctions, or acts of public authority. We will tell you what's happening and reschedule, refund, or cancel as appropriate.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict-of-law rules. Disputes will be brought before the competent courts of Varna, Bulgaria.
If you are a consumer, the mandatory consumer-protection laws of your country of residence in the EEA apply to the extent they grant you broader rights, and you may bring proceedings in the courts of your country of residence.
For online disputes, you may use the European Commission's ODR platform. We are willing to participate in ODR proceedings.
18. Changes to these Terms
We may update these Terms from time to time. The version in effect at the moment you place your order governs that order. We post any new version on this page and update the effective date. Continued use of the site after a change means you accept the change for future orders.
